Welcome to TradWay International. These Terms & Conditions govern all business interactions, website usage, quotations, purchases, exports, and related services offered by TradWay International.

1. Definitions

  • Importer/Buyer/Client refers to the individual or organization purchasing goods.
  • Goods/Products refers to items supplied by the Company.
  • Order/Purchase Order (PO) refers to a confirmed request for goods.
  • Shipment refers to domestic or international dispatch.

2. Acceptance of Terms

By confirming a purchase order, making a payment, or engaging with the Company, the Buyer accepts all conditions stated herein.

3. Quotations & Pricing

  • All quotations are valid only for the period stated.
  • Prices may vary based on material, logistics, or policy changes.
  • Taxes, duties, freight, and bank charges are the Buyer’s responsibility unless agreed otherwise.

4. Purchase Orders

A purchase order must include:

  • Product specifications
  • Quantity
  • Packaging requirements
  • Shipping details
  • Compliance or certification requirements

Orders without written confirmation will not be processed.

5. Compliance & Certification Responsibility

  • The importer must specify all compliance requirements and certifications needed in their country.
  • All compliance requirements must be clearly mentioned in the Purchase Order.
  • If any additional certification or compliance requirement appears after shipment, the Company is not responsible.
  • If no compliance is mentioned in the PO, the Company is not liable for any customs, regulatory, or legal issues in the importing country.
  • The importer is advised to check the HS Code and confirm duties and regulations before placing the PO.
  • Once the PO is confirmed and payment is received in the bank, no cancellation, return, refund, or policy applies. All liability is on the importer.

6. Production & Lead Time

  • Lead time begins after confirmation of PO and payment.
  • Delays due to customs, logistics, or external events are beyond Company control.

7. Payment Terms

  • Payment methods may include advance payment, LC, TT, or agreed milestones.
  • All charges outside India are the sole responsibility of the importer.
  • No charges outside India shall be borne by TradWay International under any circumstances.
  • The Company is not responsible for bank delays, LC discrepancies, or intermediary bank issues.

8. Shipping, Risk & Delivery

  • Risk transfers to the Buyer once goods are handed to the carrier as per agreed Incoterms.
  • Transit delays, damage, or loss fall under logistics or insurance responsibility.
  • The Buyer must ensure correct receiver and delivery information.

9. Inspection & Quality

  • The Company conducts inspection before dispatch.
  • Complaints must be raised within 48 hours of receipt with proper evidence.

10. Returns, Replacements & Refunds

  • Due to the nature of products, no returns or refunds are accepted unless goods are proven defective or incorrect as per PO.
  • Replacements, if applicable, are subject to evaluation.

11. Intellectual Property

All content, branding, and documents remain the property of TradWay International.

12. Limitation of Liability

The Company is not liable for:

  • Logistics or customs delays
  • Issues caused by improper handling by the Buyer
  • Additional compliance needed after shipment
  • Costs, penalties, or duties in the Buyer’s country

Liability is limited to the value of goods supplied.

13. Governing Law

These terms are governed by Indian law. Disputes fall under the jurisdiction of Surat, Gujarat.

14. Amendments

The Company may modify these Terms & Conditions at any time.
